Protecting your legal rights

In the meantime, keep in mind that any other parties such Prosecutors or the Police are not involved to assist you in your legal proceedings and that their priority is to collect statements and information that is to be used against you (not for you).

Despite any good intentions to try and assist, justify yourself or appeal to the better nature of the Police officers involved, it is essential that a lawyer is involved during any talks to ensure that you do not incriminate yourself or give misleading or factually inaccurate information which can often happen whilst under stress or pressure.

Seek legal advice immediately

Many people put off speaking to a lawyer because they are adamant that they are innocent – however, innocent people have been prosecuted because they do not understand the law and how what you say to Police can unknowingly incriminate or limit their defence.

It is vital to not take legal advice from Police Officers as they are not qualified lawyers and they are not required to look out for your best interests, especially if they are trying to prosecute you.

Anything you say to the Police can and will be use against you, not for you – if the Police are trying to build a case against you, they are not going to bring up anything you have stated to support your case, only theirs.

You have the right to a lawyer

Regardless of what you are crimes you are accused of, you have the legal right to consult with a lawyer and you have the right to remain silent when being questioned by the Police.
